New Italian entry visa and work permit for digital nomads and remote workers
The Italian Law no. 25 of 28th March 2022 has introduced a new entry visa and work permit which allows extra-EU citizens to enter and stay in Italy in order to carry out their working activity. (“Digital Nomads Work Permit”).
Both self-employed individuals and employees of foreign companies, which are not established in Italy, can apply for the Digital Nomads Work Permit, provided that the self-employed worker or the employee:
- Is a highly qualified worker or employee.
- Is enabled to carry out their working activity remotely) by using IT tools.
- Holds comprehensive, valid health insurance.
- Complies with all tax and social security provisions set forth by Italian applicable laws.
The procedure and formalities to be carried out by the foreign individual to request and obtain the Digital Nomads Work Permit are more streamlined than the ones to obtain the other types of Italian entry visa and work permits.
In fact, in case all the conditions and requirements provided for by the relevant law are satisfied, the foreign individuals are entitled to enter Italy outside the conditions and quotas established by the so called “Decreto Flussi”.
The Decreto Flussi is a decree issued every year by the Italian government which establishes the number of extra EU citizens (quotas) who may enter the Italian territory during the year in order to carry out their working activities in Italy without obtaining the so called “Nulla osta al lavoro”.
The Nulla Osta al Lavoro is a permission to work in Italy, which is issued to the foreign individual by the competent Italian immigration authority, provided that all the conditions set forth by the relevant law are met.
Once the foreign individuals have obtained the Digital Nomads Work Permit, they are entitled to stay in Italy for a period not exceeding 1 year.
The Italian government is going to issue a decree to clarify the formalities needed to request the Digital Nomads Work Permits, the categories of highly qualified workers and employees which can apply, the minimum income thresholds of the same and the modalities by which the competent authorities may verify the working activity to be performed in Italy by the foreign individual.
This new regulation will impact employees of foreign companies who intend to work remotely from Italy, foreign companies that intend to assign their employees to Italy, and self-employed individuals.
